Read Case 12.8, on page 442-443 of our textbook. Then answer the following three questions provided at the end of the case study:
- Does the Oncale decision transform Title VII into a general civility code for the American workplace?
- What standard should apply in judging whether the conduct in question amounted to sexual harassment?
- What justification exists in the statutory language or Supreme Court precedents for a categorical rule excluding same-sex harassment claims from coverage of Title VII?

Overview:
In our Unit 4 assignment, we will focus on explaining employer liability for sexual harassment.
In this case study, you will explore what actions amount to sexual harassment and how this
case impacted Title VII’s impact on the workplace.
Instructions:
Refer to case study 12.8 – Oncale v. Sundowner Offshore Services, Inc. on page 442-443 of
your textbook. Then answer the following three questions provided at the end of the case study:
1. Does the Oncale decision transform Title VII into a general civility code for the American
workplace?
2. What standard should apply in judging whether the conduct in question amounted to
sexual harassment?
3. What justification exists in the statutory language or Supreme Court precedents for a
categorical rule excluding same-sex harassment claims from coverage of Title VII?
