Youare an ATTORNEY representing an individual from ONE of the following cases. There is a Hearing before The Honorable CHARLES F. PETROLAWICZ, BCC Student’s Court. ONLY ATTORNEYS (NO CLIENTS; NOR WITNESSES) will be present.

IF you are a DISTRICT ATTORNEY/US ATTORNEY GENERAL, you are obligated to provide ALL OTHER ATTORNEYS (Discovery) with copies of your presentation BEFORE YOUR PRESENTATION. (Note: Other Attorneys are NOT obligated to provide the DISTRICT ATTORNEY/US ATTORNEY GENERAL with copies.) In compliance with discovery the Plaintiffs’ Attorney will provide the Defense Attorneys a copy of their presentation; and Defendants’ Attorney will provide the Plaintiffs’ Attorneys a copy of their presentation.
At the Hearing you will orally present your arguments and respond to the other Attorney’s presentations. Please review Chapters on trials and your case! You will be evaluated: Written Presentation 10%; and Oral Presentation 20% (includes 5% on dress; 3% for copies).
CASE 1: (2 STUDENTS) John wanted to remodel his kitchen. At the Bar, where he was getting intoxicated and watching the Game, a friend recommended that he stopped at Kitchens Remodel. The salesperson, smelling John’s breath, wrote out a contract stating that the price was good for only the next 3 days. John did not sign it. He said he wanted to sober up and think it over. Five days later the Salesperson showed up to take the measurements. One week later the contractor showed up at John’s home to start the project. John refused to let the contractor in. John called Kitchen Remodel stating that he never signed the contract because the price was too high. Kitchen Remodel said someone must pay for the cabinets.
